These Creator Terms apply if you publish courses, live classes, coaching, or other content on Evalanta as a creator, instructor, or coach. They form part of our broader Terms of Service.
1. Creator eligibility
You can become a creator by opting in through your account or completing a short creator application. You must be legally able to enter into contracts, provide accurate identity and tax information where required to receive payouts, and comply with all applicable laws. We may revoke creator status for breaches of these terms, fraud, or legal compliance reasons.
2. Your relationship with Evalanta
You are an independent contractor, not an employee, agent, or partner of Evalanta. You are responsible for your own taxes, insurance, and compliance with laws in your jurisdiction.
3. Content standards
You agree that all content you publish will:
- Be accurate, original, and not infringe any third-party intellectual property;
- Comply with applicable law, including education, consumer, tax, and content regulations;
- Not contain hate speech, harassment, discrimination, violence, illegal activity, sexually explicit material, or malware;
- Not mislead learners about outcomes, accreditation, or employment prospects.
4. AI-generated content
You may use Evalanta's AI-assisted tools to draft outlines, lessons, quizzes, and marketing materials. You remain fully responsible for reviewing, fact-checking, and editing any AI-generated content before publishing. You must clearly disclose to learners when significant portions of content are AI-generated, where required by law or platform policy.
5. Revenue share and payouts
You earn a share of the revenue from your paid offerings. We deduct:
- Evalanta platform fees;
- Payment processing fees charged by Stripe, bKash (subject to final partnership approval), or other providers;
- Applicable taxes and withholding, including Bangladesh TDS where required;
- Refunds, chargebacks, and adjustments.
Payouts are subject to minimum thresholds, verification, and holding periods described in your creator dashboard and our Payout documentation.
6. Bangladesh tax obligations
If you are a Bangladeshi creator, you can add a valid e-TIN to your tax profile. Providing an e-TIN is not required to create or publish courses, but it is required to receive payouts. We are required to deduct tax at source (TDS) from Bangladeshi payouts under local tax law and will issue tax deduction certificates. The TDS rate is 10% when your e-TIN is verified by us, and 15% when no verified e-TIN is on file. You are responsible for reporting your income and claiming any available credits when filing your tax return.
7. Learner data
You may receive learner data necessary to deliver and assess your courses, such as names, email addresses, submissions, and progress. You may only use this data for that purpose, must keep it confidential, and may not export it for unrelated marketing or share it with third parties.
8. Refunds and chargebacks
You agree that Evalanta may issue refunds and process chargebacks in accordance with our Refund Policy and applicable law. The amount of any refund or chargeback may be deducted from your future payouts.
9. Termination and content removal
You may remove non-mandatory content or close your creator account at any time, subject to your obligations to enrolled learners. We may remove content, suspend payouts, or terminate creator status for breaches of these Terms, poor learner outcomes, fraud, or legal compliance reasons.
10. Indemnity
You agree to indemnify Evalanta against claims, losses, or damages arising from your breach of these Terms, your content, or your misuse of learner data, except to the extent caused by our own negligence or unlawful conduct.
11. Changes
We may update these Creator Terms. Material changes will be notified at least 14 days in advance. Continued publishing after the effective date constitutes acceptance.
